Terms of Service Agreement Version 1.04 Last Updated: 2006-01-22 with spelling and grammar corrections, and changes to the agreement. In this document “Site” or refers to MaleBots.Com and its affiliate web sites and services. “The Management” refers to Imagine A World, its partner operating companies, and site administrators. Welcome to MaleBots.Com. Please review the following rules and Terms of Service agreement required for your use of this site and it's products and services. Please note that your use of site services constitutes your agreement to follow and be bound by these terms. Changes to Agreement We may from time to time change this agreement. Your Use of our Site following any such change constitutes your agreement to follow and be bound by the rules and terms as changed. You will be notified of any agreement changes on your first attempt to log in after the changes have been posted. Copyrights and Trademarks MaleBots and the names of individual sites are trademarks of Imagine A World. The contents of the site, including images, illustrations, designs, icons, photographs, music, video clips, written texts, and other materials that are part of the Site (collectively, the "Contents") are copyrights, trademarks, trade dress and/or other intellectual properties owned by Imagine A World, our contributors. Links to other Web Sites and Services To the extent that MaleBots.Com contains links to outside services and resources, the availability and content of which the Management does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource. Content Usage By providing Content to the Site, you agree to allow such Content to be displayed on The Site and, by extension, to be distributed to Site users via the Internet. Further, you agree to allow such Content to be used in Site promotions in any conceivable media format and to be used by affiliate sites. By providing content you are waiving exclusive rights to this content and agree that you are doing so without benefit of financial compensation for contents you provide. Content which has been uploaded under a “Content for Access” policy may be subject to a separate agreement entered into at the time of contribution. Deletion of Contents The management reserves the right to remove your content and information from the site for any reason with or without notice. This includes any personal messages, forum posts, and user settings such as friends lists. In some circumstances, requests for removal of your Content from this site may be honored. Decisions to remove content are strictly at the management's discretion. Responsibility for Contacts This site is designed to facilitate social contact of persons with similar interests via profiles, messaging, and other means of sharing content. You agree that profile data you provide may be shared with others, and that as such other people known and unknown to you may contact you and that such correspondence, even if delivered via Site services, is not necessarily screened, endorsed, or witnessed by the Management. By using the site you agree to take responsibility for any and all consequences of any personal or electronic contacts made through this service. You understand that these contacts and associated events are outside of the control of the Management, and agree that the management will not be held responsible for any damages due to use of this site. You agree to contact management immediately in the event you are being harassed by anyone using our system. Adult Content Some of the content on this site is of a nature suitable for viewing only by adults. You agree that you are an adult, and that it is legal for you, in any locality in which you may access the Site, to view adult-oriented sexual content. You agree to discontinue use and forfeit any membership expense in the case you move into a jurisdiction where it is not legal for you to view site contents, or if the laws change prohibiting your use. Acceptable Use By using this site you are agreeing to use all services provided in a manner acceptable to it's owners. I understand that "acceptable use" includes, but is not limited to: o using the bulletin boards and chat rooms for their intended topics. o refraining from "flaming", "spamming", threatening or libelous messages. o avoiding overt advertisements of products. o keeping your access code to the site secret. o respecting the confidentiality and privacy of other members. o viewing the site only through it's intended interface with a standard internet browser. o not collecting and storing site contents locally. o Not copying. redistributing, selling or trading, the site's content to third parties I understand that the membership fee for this site buys only the service of producing and presenting it to you for a limited time. By using the site you have the right to access the available contents only for the agreed amount of time. Caching, copying, redistributing or selling the contents of the site is strictly prohibited. There are no guarantees or warranties of content availability. I understand that The Management reserves the right to refuse to accept certain names or ID's that members may request to represent themselves. I understand that parts of this site may require special computing equipment such as a broadband internet connection and special software to function properly. I agree to take responsibility for having a computer system that meets the requirements for the services I will want to use. Prohibited Use Images of a pornographic nature involving persons under the age 18 years at the time of production are strictly prohibited on this site. Any suspicious imagery should be reported to management immediately. By entering this site you are agreeing to take responsibility for protecting your access to this site and preventing it's use by those under under the legal age of use. In the spirit of compliance with 18 U.S.C. 2257, the Federal Labeling and Record-Keeping Law penned before the invention of internet sites, records are kept of this agreement with the date and your IP number. You are responsible for the legality of the images you post on this site and are expected to know the laws as they apply to your actions in your jurisdiction. Images or stories that depict sadomachicism in a sexually explicit context are not permitted. The management reserves the right to refuse content for any reason. Posting of adult oriented content requires compliance with 18 U.S.C. 2257 regulations. All contributions to this site are produced and/or edited by the management and their agents, and comply with the requirements of 18 U.S.C. 2257 and associated regulations. All persons who participated in adult acts captured by management and their agents were 18 years of age or older during the time of photographic rendering. Termination and Abuse The Management reserves the right to terminate service, with or without compensation or refund, to any anyone it deems to be in violation of policy or otherwise utilizing the Site in an inappropriate manner. Investigation From time to time, Management may require additional information from users, such as photo identification or a credit card authorization, to verify identity, especially, but not including, in the event of the receipt of a complaint. You agree to supply such relevant information when contacted by Management, and that failure to provide correct information in a timely manner will result in termination of services without compensation or refund. Management may provide information in response to specific law-enforcement enquiries, and shall comply with such requests as required by law. Additionally, your information and/or personal content may be used to resolve billing disputes or for other administrative purposes. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE MANAGEMENT DISCLAIMS ALL WARRANTIES OF ANY KIND IN CONNECTION THEREWITH, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE MANAGEMENT IS NOT RESPONSIBLE FOR ANY LOSS OF MEMBERSHIP, MEMBER DATA OR CONTENT POSTED OR CONTRIBUTED TO THE SITE. IN THE EVENT THAT MALEBOTS.COM CEASES OPERATIONS, MEMBERS AGREE TO FORFEIT ANY REMAINING MEMBERSHIP TIME AS WORTHLESS. THE MANAGEMENT WILL NOT BE HELD RESPONSIBLE FOR REFUNDS OR OTHER COMPENSATION FOR LOST MEMBERSHIP TIME OR ANY DAMAGES RESULTING FROM THE SITE'S CLOSURE. Privacy Policy Our privacy policies are continuously changing due to the dynamic nature of information technology and Internet law. The following policy statement may change without notice, and customers are encouraged to check this page for the newest in policy changes. Our policy is to always try to respect your privacy. The Management has never sold or traded customer information to third parties. The Management will not knowingly use personal customer information in ways which violate laws of the Unites States of America. The Management is opposed to spam and supports legislation to end mass annoyance E-mail. The Management may, however, use your email address in the following ways: 1. To send test and verification emails to determine the validity of your email address. 2. To send notifications, news about new features, and Site updates. 3. To send promotions about products offered by The Management. 4. To send promotions on behalf of a third party related to the topic of the site, without directly disclosing your E-mail address to the third party. Paid members (subscribers) and Contributing members may be able to, via email or in the account preferences setting, opt-out of modes 3 and 4, above. Additionally, The Management may share anonymous "aggregate" data with third parties such as for the verification of banner ad performance and to provide information about the overall makeup and usage of our Site. Members and visitors to the site and it's partner sites may see your online status and may be able to monitor your online activities such as profile viewing. Site customers, site members, system administrators and other persons may legitimately access personal content and information you enter in our systems. Our online store uses a product recommendation system that uses aggregate order information based on products you order. This system allows customers to identify similar products and locate popular items. Use our systems at your own risk. Computer information systems and global information networks contain inherent security vulnerabilities, and government spy systems. Management makes no warranties about privacy, safety or security of customer information and content. Management will not be held responsible for any damages that result from use of our systems. Agreement I have read and understand these terms of service. I understand that if I violate these terms that my access to this site may be discontinued, any contributions that I have made may be forfeited, and that this may occur without notice or recourse. I understand the owners of this site may prosecute for copyright infringement and for other damages as justified.
